It's a race to get as many people on board as possible. The firm with the largest group is most likely to get certified. And the statement of claim or the parties to the suit won't have been determined yet.

I still think that it's bad form to do it before the dead are buried, regardless of the reasons.

Oh I'm not disagreeing. This is a battle between law firms. It ain't gonna be pretty. The clients aren't served any better by this race other than perhaps giving them the sense of power in a situation where they have none.
