Daniel mentioned this to me over the phone yesterday, so I looked it up.

Using Guard troops to "enhance security" at the border would violate the Posse Comitatus Act...

...and a few years ago I would've followed that with "which would never be allowed to happen in this country," but since so many violations elsewhere have been allowed to happen...I just don't know anymore.

On the other hand, Guard units ARE deploying to the mideast at a pretty high rate- so as far as Daniel himself is concerned, the possibility of that is probably greater.

regardless of the constitutionality (it is unconstitutional and stupid policy), It would probably be the VERY safest deployment for Daniel. Bush has already said they arent allowed to be involved in police actions or transportation etc (to try to comply with posse comitus (um.... i just spelled that wrong).

So honestly Jess... he'd probably be much safer tehre than anywhere else.

Actually it's perfectly legal to use the Guard as a police force...think back to the LA riots if you need an example. The key lies in ownership. The Regular Army is a federal force and it's restricted so it doesn't infringe on the sovereignty of the states. The Guard is owned and controlled by the states - it's the only component of the military that can perform a police role. In any case, like Michael pointed out, this deployment will be purely for logistical support.
