I appreciate your advocacy of the devil, sir.
Consider, for a moment, though, the source. ZDNet isn't exactly the picture of free thought these days, indeed, sometimes, they don't seem the picture of any sort of thought. This Mr. Ou's viewpoint echos that of so many Softies, to boot. "Vista DRM is fine, you won't even notice it's there, oh, and by the way, Free Software doesn't matter."
If someone coiled a venomous snake around your leg, which immediately began staring at your genitals, and informed you "Oh, it's fine, he's not there to take anything away, just to make sure you're able to do things," what is your thought going to be? "Oh, I won't notice it after a while"?
The fact that DRM is built into almost every facet of Vista is just a downright terrifying proposition, even if you might not notice it through the nice stained glass. It's in there. It's watching. And if Microsoft deems it, it can go from innocent walls of the OS to full-mecha-battle-readiness, as outlined in the EULA. The issue is not that DRM does anything

I will most definitely give you that ZDnet is not the greatest source ever, or even close to it. Some of the points they make are more valid than others, and those seem to be the ones that you don't take issue with, so I think on the parts of the arcticle I cared about we agree. That bit being that the DRM in vista probably doesn't affect preformance in video games (other things in vista might though) and that currently, the DRM is imposing no undue restrictions on users. Are these correct assumptions

As for DX10, I'm thinking more and more seriously about becoming an exclusively OpenGL man.
