I suppose I wouldn't be so against it if "safely" was defined. The issue at hand is now we have given irresponsible cyclist an avenue of defense. Seeing as how "safely" is determined on a case by case basis, a multitude of excuses could be used by a bicyclist or a lawyer in a wrongful death lawsuit as to why this bicyclist was right and the motorist was wrong.
It could all be avoided if bicyclist would chill and just follow the laws like everyone else. That way, if a motorist does not give the right of way as though he would to any other vehicle, then it is CLEARLY the motorist fault. If a bicyclist blows a stop sign and gets pegged, he is CLEARLY dead/maimed because he didn't pay attention, and the motorist only has to live with the fact that he took part in someone's death and not get sued on top of it.
