Sounds like malpratice. I don't think if it's a necessary or unnecessary operation that it should matter. As long as the doctor has a duty to the patient, a breach of that duty that causes harm is a tort.
At the same time she likely should have known she was 6 or 7 months pregnant.
Maybe the doctor should be liable for the time between the failed abortion and when a reasonable person should realize she is pregnant.
Also, scary precedent - cost of child care could be expensive. ah well i'm out of time, and not caring enough to research this.
