Trial Part 249
Thursday, April 20

“Describe for me the night you were attacked by the defendant...” Ms. Novak questioned the shaking victim on the witness stand.

“Objection, Your Honor,” the defense attorney raised his hand, “leading!”

“Sustained,” the judge said. “Ms. Novak, redirect.”

“Apologies, Your Honor,” Ms. Novak softened her tone, “Tell us what happened the night in question.”

“Well,” the tiny, blue-skinned blonde trembled like a leaf, holding a handkerchief, “I was just smurfing down the road, picking some mushrooms for Grandpa Smurf’s tea.”

“Is it safe to pick wild mushrooms in New York?” Casey asked.

“Objection! Relevance!” the defense attorney shouted.

“Sorry, again...anyway, Ms. Smurfette, continue.”

Smurfette’s voice quivered a little, “Well...anyway...I heard footsteps smurfing towards me. I thought it was just some smurfer-by, but then...” Smurfette started to sob.

Casey leaned closer, “Please, try and continue.”

“...then, I felt these hands grab me from behind. I felt a rag being smurfed over my eyes so I couldn’t see, then a voice smurfed in my ear, ‘Make a move and I kill you!’” Smurfette choked back a sob.

“Then what happened?” Ms. Novak urged her to continue.

“Then...the stranger smurfed me across the ground...”

“I’m sorry... ‘smurfed?’” the defense attorney was confused by the victim’s dialect.

“You know...” Smurfette made a gesture with her arms, like dragging something.

“You were dragged somewhere, correct?” Casey repeated, and the smurf nodded. “Then what?”

“Then,” Smurfette’s teeth clenched, trying hard to stifle a cry, “He threw me on the ground, and...smurfed my hands together behind my back...” She made a gesture of her hands being bound, crossing her bruised wrists. “I was...lying on my stomach. Everything was dark. The ground was so cold...” Smurfette started crying. The defense attorney looked unmoved, his client sat emotionless.

Casey whispered, “You’re doing great. Just keep going.”

“Your Honor, the witness is far too distraught,” the defense attorney objected, “the prosecution is torturing the poor...thing.”

Casey shot a basilisk glare at the defense attorney, “Oh now you’re so concerned for the victim’s feelings yet you call her a ‘thing?’”

“Enough!” The judge banger her gavel, then looked down, “Ms. Smurfette, are you alright to continue?”

“Yes,” Smurfette nodded, fighting back her tears.

Ms. Novak asked, softly, “After you were thrown on the ground and tied up, what happened?”

Smurfette took a deep breath, “I was kicking my legs, trying to smurf myself free, but the stranger held them down, saying, ‘I’ll smurf your legs off if you don’t smurfin’ stop!’ Then, he grabbed my panties, and smurfed them down around my ankles,” Smurfette started sobbing again. “He put his fingers up my smurf, saying, ‘Oh, I’m going to smurf you so hard, you little blue slut!’ I screamed, ‘NO! NO PLEASE! DON’T!!’ But he just laughed, ‘Scream all you like, I’ll smurf you harder!’ Then, I heard a zipper unzip, and...and...”

Casey urged her to continue, “And what? What did he do?”

Smurfette wailed, “HE SMURFED ME!! He smurfed me up my smurf, over and over and over. He kept saying, ‘Oh you feel so smurfin’ good! You like me smurfin’ you, don'cha?! I can smurf you all night long, you smurfin’ whore!’” Then, she buried her face into her handkerchief, crying uncontrollably.

“Objection! This is ridiculous!” the defense attorney threw up his hands. “Did anyone understand a single word she said! ‘Smurf’ this and ‘smurf’ that!”

“Your Honor,” Ms. Novak said, “the victim has a language barrier! We can’t force all our rape victims to speak perfect English.”

“Overruled,” the judge glared at the attorney.

“But...” the defense attorney objected again.

“I said overruled! Or do you want me to charge you with contempt?” The judge said coldly.

Ms. Novak leaned towards Smurfette, “You're almost done. You're doing great. You're very, very brave. Can you continue?”

Smurfette blew her nose and nodded, “Mm-hmm.”

“Alright..what happened next?”

Smurfette said, voice shaking, “After he finished smurfing me, he just...left. Left me half-naked on the ground, smurfing from the cold and the pain. That’s when the nice cop found me.”

“Detective Stabler?” Casey asked.

Smurfette nodded, “One of his kids picked me up. He said, ‘Daddy, Daddy, look what I found!’ His ‘daddy’ un-smurfed my hands and face. He told me he was a police officer and showed me his badge. I told him someone smurfed me, and he brought me to the hospital. The detective said, 'I'll get the guy who did this. No one's going to hurt you like that again.'” She wiped her eyes with her handkerchief.

Casey smiled gently at the little smurf. “No further questions, Your Honor.”
