I say use the money. The bank screwed up, and from the way it sounds, thus far, has no made an attempt to correct their mistake. So you would be in the right to use money. Not too many breaks come in life, take it while you can.

Besides, look at it this way, banks are constantly screwing people over, this is your chance to stick it to the man.
