Wow. I've been in that accident.

From the way you've described it, I would say that you were "in control of the lane" and thus the accident is the other person's fault (since you were mostly straight and they were backing out).
At least, that's how it went against me.

I once got the joy of watching somebody back straight into a car that was just driving through the lane (hitting it in the rear-wheel area) and then get out and claim that the other party was at fault. She refused to believe me when I explained the above to her and then accused me of being a racist skinhead because I was choosing to take the other woman's side in the accident. Gotta love some people. ...'cause if you don't, I hear the penalty for beating them to death with a log is pretty steep.

Wow, a racist skinhead, that's pretty funny, ya there was no name calling, she was actually pretty cute, really nice as well.
I got to watch someone back into somebody like that as well, there was no name calling though, kinda a bummer deal

When my brother did that to somebody, he got WAY lucky. He got out of the car, all ready to apologize, and she's all "oh, well you're just fortunate that you hit an old hippy. I'll just buy some touch-up paint to conceal it. Here's my contact info--get me a check for $20 and I won't report this."

I think she was either crazy or hiding from the law, personally...

Bummer for your car. Yeah I backed into a parked car on the way to a presentation. I was really calm about it you know (she says in a sarcastic tone) I cried because I only had my car for like a month and I was late to my presentation but the guy I hit was super nice and I think felt extra bad because I was crying. Sometimes you just can't beat being a girl
