Sooooooo in the big pre "are we or aren't we going under" confusion that went on a few months back (oh how I laughed at those who had any doubt or held out hope) I screwed up royally by not putting my last offically paycheck that was actually FROM Borders in the bank (long story short I had a relative that died and in the ensuing chaos it got lost ( Read more... )

I'm not sure what the number for pay dept is, but it does seem like you should be legally entitled to your pay. I don't think you're without a paddle yet, but I do think it'll be hard for you to claim that cash.

You may have to go thru the courts and get in line with the other creditors who are owed money by them.

I don't understand fully. Do you mean you still have the paper check and believe it won't be honored because the company has liquidated? Or that you never received the paper check at all?

No, it's over the 90 days limit. It's now void, hence - uncut.

Call HR, there are still people there. Before we closed there was a notice saying to call them with paycheck issues.

Often banks don't look at those "void after 90 days" notes, so you may want to try depositing it anyway (maybe through an ATM instead of a human teller)

I was told if I attempted it by my bank that not only would they refuse the check but they would charge me 25 bucks. :(

*Neatly* draw a line through that void after 90 days statement with a black Sharpie so it completely can't be read, then deposit it. Seriously. If there is still money in the Borders account, it will clear. If there isn't, you might get charged a fee from your bank. But then you have a claim against the Borders bankruptcy estate, which may be worth something.

I wouldn't give up a week's pay because of a throwaway line on a check, especially one that can be deleted. Did your employment agreement or manual tell you you had to cash their paychecks within 90 days? I doubt it, so the fact that they put it on there doesn't mean a thing. What if it had said "Void after 1 week"--would that be valid? How about "Void after 1 day"?

Cross it out and cash it! Or deposit it into an ATM.
