and I saw this article about private file sharing networks where people setup their own little encrypted peer to peer network with an encryption key to keep identities and the traffic secure from prying eyes, and the admittance is by invitation only. I heard an idea similar to it bandied about by some people a couple of years ago ( Read more... )

Breaking the privacy is only DMCAable if it's violating a particular product. Given that any serious private p2p is probly going to be open source / ietf standards, likelihood of prosecution is very low.

OTOH, detecting these networks may very well be difficult.
