From having done a some research it appears that we are not in violation of the wording of the treaty currently (Russia definitely is), on the other hand I think we are violating the spirit of the treaty and that has serious repercussions on the willingness of other countries to continue under current treaties, and all but elminates the chance of any new countries joining.
