Let's be fair - this thing was started by a bunch of nerds in Seattle, a location that is pretty naive at the best. They have no policies because they have been blissfully ignorant until now - and also because until 6A bought them, I doubt that the concept of "legal protection" had occurred to them. I consider 6A the responsible body in this situation, not LJ. The initiator of this situation clearly thanks two 6A managers for their part in the mass suspensions. The LJ crew, I am sure, just followed the screamed orders.

Mr. Berkowitz is clearly an idiot. I agree with jereeza, they've obviously been dealing with the entire question thus far by refusing to consider it. Now that they have to, they're flailing.
This recent debacle was implemented by very simply yanking all those accounts where there were certain keywords in the profile. Nothing else seems to have counted. Display a keyword, get suspended.
That LJ is a U.S.Atian company makes it eminently sensible that you just don't talk about certain things. After all, the advertisers would not like their products to be connected to all kinds of filth.
