Sherlock will be watching Elementary like hawks, ready to sue their ass if they rip anything off.
Actually, come to think of it, maybe the threat of lawsuit was the real reason Watson was gender-flipped.
...I'm kinda hoping they screw this up and get sued. That will bring media attention and will bring Sherlock to further notice to the American audience. People love to obsess over details and argue on the internet, so if this comes to a lawsuit, the nerds will watch both just to be able to compare the two. A lawsuit would enlarge the Sherlock audience!
Unless the show directly steals some title (like "A Study in Pink") or a character (like Anthea or Molly, maybe), I'm not sure there are grounds to sue. Nobody owns Sherlock Holmes, so anyone can make him into any incarnation they like.
Still, I doubt anyone can match BBC Sherlock in style, wit or cleverness. People might watch this new thing for a couple of episodes, but I doubt it'll catch on.
The gender-flip sounds like a bid to make the show different for no other reason than to make it different. What will probably happen is that Joan Watson and Sherlock Holmes will operate as intellectual equals, solving crimes together, which is not how the dynamic has ever worked.
I can just see Jeremy Brett saying, "tsk, tsk, what will those Americans do next? Can they not try something original?"
I think you're right in that any controversy is sure to benefit BBC Sherlock. I'm looking forward to that!
Oh, there are risks, such as(even accidentally) imitating style, music, character design(as in big posh coat or jumpers), etc.
