That's interesting. I hadn't thought much about this topic, but you bring up good points. I think the reason a lot of voters are willing to get behind this (or at least not get up in arms over it) is because of the widespread (but rarely supported) belief that the damages awarded outweigh the actual damage (e.g., the McDonald's case). I'm sure a factor in this is that people are unaware of how much court and lawyer bills add up to, which is often factored into settlements.
