Hey there,

looks like trouble for DD. The Red Hot Chili Peppers sued DD according to an article in the online edition of Rolling Stone magazine:

I've also read this a few days ago anywhere and I also thought that this is kind of weird. Though I don't know the origin of "californication" but I don't believe that it' a expression by trhcp ...

Hm, to be honest, I thought first about Californication by the RHCP when I read about the show in your lj.
But nonetheless, I don't think they have a trademark on the word? That's a bit over top... It's like, yes, I identify the word with the album and therefore the band, but why shouldn't a TV-show use it too? Strange enough.
And I agree that the time they choose to come forward with this looks suspicious ^^

Nope, they don't own the rights for the term Californication. I mean what's next? Hotels are not allowed to use the term "Room Service" anymore because there is an album of the same name by Bryan Adams which sold pretty well? Give it a break...

I just wanted to drop by and say a huuuuge thank you for the DVD! That was so sweet of you! *huggles endlessly* I watched it today, when I had to look after my little brother. And it was amazing. I love it in English. I mean, I loved it before, but even more in English. :)

Hmm, last I heard you couldn't put a copywrite on titles anyway. The things people sue for these days are ridiculous.

Who knows. . .it's like the folks who arrested a couple of border patrol agents for stopping marijuana smugglers from crossing the border. In fact the smugglers were granted immunity to testify! Now border agents are in jail and they smugglers just tried to get another load across.

I guess I understand where they're coming from, I mean when I first heard about the show I immediately thought of the Red Hot's song and album (which I love, for the record :D) but since they didn't actually create the term, this case seems pretty stupid in itself, not that I know many things about copyright infringement in the US. ;)

Anyway, I'm sure Showtime have some lawyers and I'm pretty sure they heard the song before the show started to air too. I'd be really surprised if they didn't make sure that it wasn't going to be a problem. :)

I surely hope this case won't even go to court. Just reminds me I wanted to check out the website of RHCP. Have the hinky feeling they have a new album up the pipe and are badly in need for some publicity...
