To begin, a couple of disclaimers. First, I have absolutely no problem with an author pulling down their story. Just like readers don’t have to review, authors don’t have to write. 2) Even in OOC fic, Stephenie Meyer just owns the character names.

TOTALLY FALSE. Stephenie Meyer owns the ENTIRE Twilight universe. This includes more than just character names. Regardless of how OOC a fic is, it was based off of Twilight and these characters. A work was created using the names and settings of another author as well as certain personality traits that were adapted to fit the needs of the story being written. That makes fanfic a derivative work. Simply changing names, physical descriptions, and settings is not enough to overcome this fact (Sidenote: the names etc are trademarks, not copyrights. That’s a different area of the law).

That's pretty much what I thought, thanks for sharing your knowledge and taking the time to write this. You should put a link or copy of this in the_gaz I know a lot of people would be interested in reading it.

Thank you for this, Kate. It definitely clears up some of the immense confusion I've been mucking through in trying to understand who's right or wrong in the recent discussions.

Twilight has the oddest (fic) fandom I've ever encountered.

thank for posting this Kate! I didn't fully understand the way it worked in other jurisdictions than my own so I'm glad you could clear some of this up. I'm looking forward to any other insights you have to offer.

Thanks for sharing this, it was really interesting. I have wondered about this, especially recently with some people putting on the top of their fic that the plot/idea is copyrighted to them. I always wondered how it all worked.
