it is that if you ever get arrested for any reason, or if the police show up to your door for any reason, tell them unequivocally that you want to speak with a lawyer and then shut your mouth. If you do this, they probably will never get enough evidence to prosecute you (whether or not you have done anything). Please promise me you will do this ( Read more... )

That's what my mom always said. Just say you want a lawyer and shut the hell up until one gets there, because no one ever talked themselves OUT of being charged with something.

After reading about a billion cases where the defendant tried to make up some story (or was telling the truth but got confused), I have come to the conclusion that it is much better just to shut up. Also, according to the case law, you must be really clear when you ask for a lawyer - no "maybe I should talk to a lawyer" or "don't I get a lawyer" but "I want a lawyer and I am not saying anything." Once you say those magic words, you are safe and the police can't bug you.
