It's odd that your insurance company isn't handling this for you, that's what they're supposed to be there for.

Look up the Kelley Blue Book Value for your car, is it more or less than the estimate for your car? If more, than they're just going to total it and hand you a check for the value of the car. Did your car or medical insurance pay for the doctor's visit? You'd need to add that in if your medical insurance paid for it.

If LESS than the estimate, not more. If you don't have an estimate for your car yet, I'm not sure what exactly you have to discuss quite yet, especially without your insurance company.

Right now the car is at the police impound lot. I have to decide if my insurance or the other guys is going to take care of it. If my insurance pays out and then goes after the other guy it will go against our policy and possibly raise our rates. Both insurance companies were sending people to look at the car today. We have until Friday to get the car out of the impound lot, so we'll likely make a decision after we talk to the other insurance company tomorrow.
Judging from the damage I don't see how the car isn't totaled, especially at how low they are valuing it.
It just sucks ass, cause he was completely wrong, going the wrong way, but we are VERY lucky he didn't hit back a foot or so. I might still be in the hospital if he had.
The police officer sited the other driver for going the wrong way, so I don't think fault is an issue at all. The other driver is claiming he never saw any signs.

I don't know why your insurance would go up since the other person was at fault, I've had accidents that were my fault and my insurance never took a hit from them.

He can claim whatever he'd like, but he is responsible for knowing the speed limit and direction of the road he's on, and no one is going to cut him slack otherwise. It's like trying to say you had no idea that the speed limit was only 25 - good luck with that one.
