Some sort of solution for the orphaned works problem is important, but I don't think this particular interation is going to make it through (at least, not without amendment). I think that because it seems not to allow a creator to exclude people from using their work, and that's one of the most fundemantal aspects of a property right.
On the other hand, compulsory licensing works really well for music (that is, you can cover any song as long as you pay a fee), and this could be seen as a way to extend that to other artistic fields.
