I made this to be copied by whoever wanted it. The image isn't the best quality, but it was the best pose for my purposes and it wasn't copyrighted.

The site where I got it said it wasn't.

Unless the site where you got it was controlled by MGM, I believe it was mistaken. The film was copyrighted on August 7, 1939, which was 67 years ago. Ordinarily, films don't come out of copyright for 70 years; however, the Copyright Term Extension Act of 1998 extended the term so that it won't come out of copyright until 2019. (Of course, there might be some special arrangements about that image that have been made with MGM, or something.)
