a followup to a termination

Mar 01, 2006 11:35

My boss talked to me. Apparently, I shouldn't have offered Dee a week to finish her position. It jeopardizes her unemployment. So we are giving it to her anyway, listing her as terminated.

Well, that's how you learn.

How does an additional week of employment jeopardize future unemployment? I don't understand how these things work :/

I don't understand how that can cause her problems. I can see how if she "quits" then she can't receive it. You have to be terminated or layed off to unemployment I beleive. (that could just be canada though)

You have to be terminated for unemployment purposes. So if Dee resigns, she isn't eligible for unemployment. However, she would have a good case against us because she could easily prove that we forced her to resign. An employment lawyer could make a case that we did it specifically to get out of paying unemployment.

Terminating Dee is easier because its clear cut, and it saves time because we wouldn't have to deal with unemployment hearings.
