Is it against the law in canada for a medical receptionist to discuss my personal info w/ my fiance if I have NOT given her permission to ( Read more... )

My suggestion would be to call legal aide and they'd be able to answer your question.

If you were particularly interested in suing their asses off, so to speak, then yes, talking to a lawyer or to some sort of governmental branch that deals with legal aid would be your first options.

I don't know what you might expect to accomplish by suing them over the matter though and it might be more productive to take the matter up directly with your doctor: not only would the whole thing probably be a complete surprise to your doctor that his receptionist even did that, but I would imagine that it'd be difficult to take legal action against her as an individual and that you'd essentially be taking legal action against the doctor's business as a whole.

Of course, I have no idea as to the nature of what was revealed by her...

I think medical secretariess are allowed limited access to patient records though (for secretarial reasons), so I'm not sure if you can be assured full confidentiality from them. I might be wrong in that.

That totally sucks that that happened. The Personal Health Information Act (PHIA) makes it illegal for ANY person working in healthcare to give out any information about you to anyone else without your written permission. There are a some pretty severe penalties and/or fines that go with it. I forget who you should talk to but either a lawyer or somebody at the government who is responsible for PHIA would be my guess.
