This story is far from new... but by god, it pisses me off SO bad that I've been bringing it up to rant about every day. I figure I may as well make a post about it and hope it gets it all out of my system once and for all ( Read more... )

You can argue all you want that Righi should have showed his receipt. I'd disagree with you, but I can't fault you for having an opinion.

However, your argument about Righi having to submit to the receipt check because he's on private property is a fallacy, a red herring. You may wish that was the case, but the law simply doesn't back you up.

Stores detain suspected shoplifters under a merchant's privilege clause in state larceny/theft laws. In order to detain someone, employees must meet the established legal standard of "probable cause" or "reasonable suspicion" depending on your state. Refusing a receipt check meets neither standard -- merchants must have witnessed the customer concealing or otherwise failing to pay for the goods. Stores can set a policy of VOLUNTARY receipt checks. Any attempt to make it mandatory is false imprisonment.

Honestly, I was just upset at how he could act like such a brazen douchebag. Yes, it's with in his rights, but I believe this is just the kind of abuse of rights that make it harder on people who act within the bounds of common sense.
