I'm following the Prop8 trial today. They're trying to decide if a gay judge can fairly decide the case, or if he should have recused himself

My take on it is that if Prop 8 is so discriminatory against gay people that a gay judge must recuse himself, it is inherently unconstitutional.

Yeah, that was my take, too. Of course, the arguments in the case were so pathetically weak, they obviously presupposed a mindset that I was trying to wrap my head around.
