I like to point out that the Founders clearly didn't intend the First Amendment to apply to radio, television or the Internet, all military-grade communications technology.
Careful-- given that radio and TV already have more limited protections, and we all know the history of controls on "military-grade" encryption, they might decide to rationalize matters the wrong way.
