Might have been a cop in an unmarked or off-duty car. But unless he was rushing to a call, non-emergency use of the lights are illegal.

It was a bmw. The statistical chances of the govt giving "unmarked" BMWs to cops for special investigations and other "cop movie shizzles" are extremely low.
