Why would anybody in their right mind think this is good for a family?

It's the same logic that grants custody rights to abusive fathers. Laws are written to protect white men. Nobody else matters.

I don't know if congress can do that, because criminal laws are usually set by the states, except for certain federal offences. I think? But the current administration is certainly repugnant enough to try.
