Vision on Patents

Patents/Copyrights/TradeMarks/ServiceMarks....huh and what not. I used to perceive these as the glamorous things. Yes they are ..put in right words they are perceived as glamorous. Now what are patents? It is junk thing which you claim as you have discovered..sometimes genuine..sometimes perceived from observing the things..sometimes claiming you ( Read more... )

Good Topic and well written.. :)

As much as i know the exact criteria are:

1) Novel..
2) Inventive or Non-Obvious [ So, either of them is considered, Hence - even
a small attachment to a chair could be treated as inventive(thou its
quite much obvious) & hence patentable..
3) Industrially Applicable..

What you said is right, even simple & silly things are patented, but many a times its the strategy to survive among competitors or to earn Royalty... Can u believe that the OK-CANCEL option [Left & Right Keys] in Nokia mobiles is also patented. This is the reason why Motorola uses it the other way & the major reason why Nokia users do not want to switch to Motorola.[ they tend to reject the call in an attempt to receive it, Delete a file in an attempt to Save it & vice versa.. :)

Btw, Yes.. Its definitely a value addition to the resume & if the invention is useful - u'd also end up being a millionaire just by getting the Royalty.. [ I have heard that Edison's descendors are still getting royalty on the sale of each bulb..

Just to correct Ravi: I don't think 'industry applicable' is a criteria. Because what is not applicable today may become applicable 10 yrs down the line, and having a patent in advance is a great boost. So you really neet not apply it anywhere. Just have a working method, that is all.

Ravi may not referring to the current age industry..:). Yes obviously it is the usefulness..which shall be industry applicable.

By industry applicable i meant - practically applicable..

Btw, They have thought abt Madhur's concern also.. The following are not patentable:
Discoveries, Scientific Theories And Mathematical Methods, Aesthetic creations, Schemes, rules and methods for performing mental acts, playing games or doing business, and computer programs as such, Presentation of information, Methods for treatment of the human or animal body by surgery or therapy and diagnostic methods practised on the human or animal body.
And of course - Inventions which would be contrary to public order or morality,.
