So I haven't read Excalibur, I don't know it's similarities to X-men. But if it's like Avengers (aka Wolverine is in Avengers so he crosses over to them but, like, Captain America isn't in X-men, so it's not a two way crossover), then I'd say focus on the characters. If you claim Excalibur, use the characters that appear in there. If Kitty is in both Excalibur and X-men, pictures from both comics are fair game but, if say Storm only is in X-men but not Excalibur, then she's not a character you can use. And vice versa, if you claim X-men, you can use characters that show up in both X-men and Excalibur, but not ones exclusive to Excalibur. If that makes sense :)
And I'd say try to make your source material from the comics only. I know it's hard, especially if you don't know for sure. In some cases, it's a judgement call and you have to do your best, but if you honestly think it's from a trading card, I'd avoid it. If you're pretty sure it's from the comics, go ahead.
It does may sense completely and is, in fact, what I would've said myself, but I wanted to be sure. :-)
Excalibur is my favorite X-title of all time, but it can be hard to find scans from them and my issues are in storage. The team actually started when the X-Men were believed to be dead, but three had survived -- Nightcrawler, Shadowcat, and Phoenix (Rachel Summers). I forget why exactly they ended up going overseas, but they ran into Meggan and Captain Britain, stopped the bad guys, and ended up forming a team. You can pretty well expect me to claim them one of these days, but first I'll be going with the main X. *rubs hands together in eager anticipation*
