I just finished being a juror on a case for the first time.  Sending someone to prison is harder than i thought it would be especially when he should of went to the loony bin.  But i had to uphold the law and use the evidence that the public defender gave to me (none ( Read more... )

I'm not saying this has anything to do with your case in particular. I mean, I think we all agree that a law against assault is just.

However, it is not your duty to uphold the law, regardless of your personal opinions. Judges say that, but they are wrong.

John Jay, the first supreme Justice of the U.S. said this: The jury has the right to judge both the law as well as the fact in controversy.

It's called jury nullification, and it means that if you don't agree with the law, you can vote to acquit.

Im sure if the jury i was on was given this fact the insane verdict would have been different and this guy would not be going to prison.
