I think I've changed quite a lot in the past year.  In fact, I know I have.  I'm not entirely sure in what ways, but I think most, if not all of them are good.  A lot of it is derived from my experiences at work, but much is also just from the changing set of friends that I've seen come around ( Read more... )

Thanks for the advice, that's helpful! Actually I would not be building on her property, but the municipal codes say you must have five feet of buffer space from the side of your house to the side border of your lot. I'm at exactly five feet right now, and whatever deck is added on to that (2.5') will still be on my property, but will violate the side lot space law. If I get the side lot easement from my neighbor, she is agreeing not to build anything on her lot that comes within 10 feet of my deck (10 = 5' for her side lot, 5' for mine)..so in effect her side lot build space decreases by 2.5'--she must not build within 7.5' of the side of her lot.

So it sounds like a permanent easement would be needed for that situation. I'll talk to the guy I'm getting an estimate from and see if he knows anything about this business. Anything else you could suggest is definitely welcome--thanks again.

It may not need an easement- every city has it's own rules and regs.
One way to interpret the house set-back is that there needs to be 10 feet between each structure for maintenance and emergency reasons... usually that just breaks down to 5 feet from each property line.
As Deck- happy as Seattle is, I'm sure there is plenty of precedent.

Some times Decks are exempt from set backs, depending on height, structure, type and style. It also depends on what the easement is. In some cases a deck could be considered landscaping.
