This was oringally an email to a friend, but I feel like it's LJ-worthy:

I feel like I need to wade into this a bit, because some people in the community may be going over the top with their reactions.  The DOMA brief last week was embarrassing, but it was actually written by a Bush Administration holdover... so I think the thing to take from this

The administration said they'd uphold the current law. I don't see a problem with the brief because DOMA is current law and the administration should uphold current law. Obama said he would work to repeal it. Whether he does remains to be seen, but we have more pressing problems right now and I'm OK with it not being done immediately. I've never been around when I president has bitten off so much to work on so quickly, so I'll cut him some slack for now.

I think most of the outrage stems from the comparison to incest, but it was a Bush appointed hardcore Mormon who wrote the brief, so we can't expect it to be too progressive. All that really shows is that Obama's strategic planners (Emanuel/Axelrod) probably didn't care enough to read the brief before it was released.

To be honest, though, it also shows that Obama is holding his promise to keep a wall between the political wing of his administration and the DOJ. Considering the previous administration, it's hard not to view this in a positive light. To hope for political meddling when it's in our favor would be pretty hypocritical after all of our A.G.A.G. outrage.
