I think that the religious protections in the New Hampshire legislation simply mean that churches cannot be forced to perform same-sex marriages, which is already ensured by the First Amendment. Catholic churches in New Hampshire can marry gays at their own discretion; to prohibit them from doing so would also violate First Amendment protections.
