I've totally noticed this. Half the time at EB they will sell the used copy at the same price as new, if it's a popular game. I bet most of the time people don't even care. That's pretty annoying that the same principle does not carry in the reverse.
I'm largely in agreement with you, but to be fair there's a difference between buying a $350 machine with moving parts and several well-publicized reliability snafus specific to the hardware, and buying a $60 disc that's almost sure to work unless it's visibly damaged.
Of course, they shoot themselves in the foot to an extent, because the obvious workaround is to damage the Xbox 360, then return it as defective. Full store credit ahoy, and EB gets left with a brick instead of something they can resell for most of its value.
It's not so much their console return policy, just that their principle of "it's open it's used" should apply to everything, not just when it's convenient for them.
