Midnyte-Wolf's Terms of Service
By sending a request for a commission, you are hereby acknowledging that you have read and agreed to the following Terms of Service. These terms are subject to revising, editing, and additions without notice. If you have any questions about the terms, please message me before payment.
1. I must receive payment before any work is done.
Commissions will not be started or added to the commission list until payment is received on my end. All payments are to be made upfront unless specified. The alternative is half up front and the second half once the work is completed. A resized, watermarked and slightly blurred version of the image will be given until the final payment is made.
Payments are only accepted through Paypal and as USD.
If no payment is sent within 3 days, the commission will be cancelled.
2. I prefer artistic liberties.
I will make stylistic choices unless specified before we agree on the commission. If you would like details and colors to be exact, please say so. Just do not nitpick poses or centimeters of marking width unless you're prepared to give me more references of exactly what you mean.
3. I will correct any mistakes, given that they were made on my behalf.
If a certain detail was overlooked, or a part of the piece was misconstrued, I'm willing to accept the mistake and correct it. However if the mistake is as a result of insufficient information or unclear references, a small fee will be charged for the correction after 3 prior changes.
Under no circumstances will a commission be redrawn.
4. A progress image will be sent prior to completion.
You are expected to approve the image before I continue. I will send a resized, watermarked sketch and flat color image.
Sketches are somewhat detailed and given to show the general composition of the character. Most corrections are recommended at this stage since they're easier to fix.
The flat colors come after the lining process and will show the more finely detailed image and the colors I've picked.
Any fixes beyond the base 3 (that are not my mistake) are subject to a $3-5$ charge depending on complexity.
5. I retain all rights to my work.
The commissioner does not have full rights to the artwork unless paid for and specifically stated by me and me only.
The commissioner may use the commission image as they please FOR PERSONAL USE ONLY. Personal use excludes any and all commercial purposes. No profit is to be made off the image. If posted online, I require being visibly credited.
Alterations to the image are NOT ALLOWED without my written consent. This includes circumstances to crop, edit/modify, change, recolor, filter, trace, or vector the image.
6. Full refunds are not permitted unless the image hasn't been started.
Once progress has been made after the sketch stage, only a partial refund will be offered if you need to cancel the commission for any reason before completion.
I reserve the right to cancel a commission, and issue a full or partial refund, at any time due to poor communication or disrespectful behavior. Depending on the circumstances, the commissioner may or may not receive what's already completed of the work and may or may not retain any usage rights whatsoever.
There are NO refunds on completed work.
