Hypothetical question to everyone:

Person A throws away a Thing. Thing is no longer useful to Person A. Person B walks by and sees Thing in the garbage. Person A clearly does not want Thing any more - however, Thing is in Person A's trash can.

Is it or is it not kosher for Person B to simply fish Thing out?

I guess your mileage may vary, but I'd say it's fair game, as long as Person B is willing to fish it out of the garbage. It's a huge concern that it's a faux pas of some kind, you can always contact Person A in whatever way you can/want and talk to him/her about it.

It's kosher. It may not be legal in some areas, but it's kosher.

I know this is odd, but is the trash can inside or outside? Outside, I see no reason not to fish it out, but inside, I'd get a little weirded out if someone was just rooting through my bedside trash can. I'd like them to ask first.

Inside trash can. I'm all about the dumpster diving outside, but this was an inside maneuver.

I'd take it. They don't want it. Trash means it's trash to them. And one man's trash is another man's treasure. I don't understand what would be not kosher about this as they were throwing it away and it was going to go somewhere where it could never be used again. When people take my 'freebies' I'm happy that it's going to a good home instead of the trash.
