So, I've been waitressing at this family-owned restaurant for two weeks as of today. Since I hadn't really discussed with the owner how much I would get per hour, I figured I would ask him today to pay me. Yes, you are definitely getting screwed over.

A few things to take into consideration:

1) Get some kind of evidence. Not that I am doubting that there are shady things going on, but whoever comes to investigate will want some kind of written documentation that you were on the payroll or staff at the restaurant. Do you keep a sign in log? Try to see if you can get a copy of that. proving you worked for the hours you did.

2) What kind of contract did you make with your boss initially? Is it on paper? Or was it verbal? As long as you have the above, if the contract was verbal he doesn't have a leg to stand on if he tries to say that he said "Well, she's a volunteer/gets paid in tips only." Especially if you are keeping proper hours and other employees are making minimum wage. If there is a contract, things could be trickier.

3) Make sure you have at least one of these documents with your name spelled correctly, as the guy will just tell them that "Oh well, that's a different girl!"

There is no written proof that I have worked there, at all. No official time sheets, nothing. I had a friend "secretly" come in and take pictures of me serving food and taking orders at the restaurant, heh. He *did* finally pay me in cash yesterday though, after a lot of work and pestering on my part....but he only paid me half of what he owes me. *sigh* Looks like I might just have to ruin his holiday by reporting him to every related agency I can think of--not just for my sake, but for the other employees he's exploiting as well. Cut too many corners and you will get yourself in trouble.
