If the message on Pandora is accurate, it doesn't really matter. All they have to do is challenge the law and it will get thrown out.
It violates one of the three fundamental tenets of the Constitution. No Ex post facto laws.

and from what I understand, the US stance on Ex Post Facto is that it's unconstitutional only of it's punative. This is regulatory, and regulatory Ex Post Facto laws have happened plenty of times with no reprucussions (even after people attempted to challenge them).

All regulatory laws are punitive in some way. They're saying they're going to be fined retroactively for 18 month. Which is pretty punative. They have to pay out the ass. That would be like the government showing up and charging us for grade school. If there had been a fee at the time we would have acted differently.
