I'm not sure that's what they were thinking, but the distinction is a hugely important one. I'm pretty sick of hearing about "activist judges."

Of course, when the CA legislature passed gay marriage (before the Governator vetoed it), opponents were crying foul over a "runaway legislature." Feh.
