Some practical questions: Has your brother pressed charges and/or will he be able to do so when he's out of the hospital? Would your brother and his family consider a court order of protection? A few years ago I had a stalker (not the same as being stabbed, I know) and the police recommended that I wait to get an order of protection because it makes some people madder and more likely to act violently. Your S-i-L might want to contact the school, demand counseling services, and contact whoever is in charge of the entire local school district if it's not forthcoming.
Replying to Eleanor and Spot, my S-i-L asked about pressing charges and was told the DA would decide what to charge him with. If the answer is 'nothing', if they believe his self-defense bs then she is definitely going to sue the neighbor. They can't really get a restraining order (they asked one of the cops that has talked to them) because their houses are closer than 50 feet and that's the minimum distance for a restraining order. It's a mess.
Obviously, any legal action that can be taken against the neighbor (criminal or civil) would be just at this point. However, if it were me, my first concern would be the comfort and safety of your brother and his family, and if the law cannot provide for that (such as ultimately forcing the neighbor to move), then it might behoove your brother to consider moving away from the neighbor. I know - it essentially rewards bad behavior on the part of the neighbor - but I fear that if the neighbor thinks that he can get away with one strike, then he might well try again.
Yeah, they're going to have to move if they can't work anything else out,for just that reason. That's the main reason S-i-Lwants him arrested,so he knows there are consequences.
