Does the phone work with the headset plugged in?

If so, plug it in then call and turn on phone insurance. They'll call you back to make sure the phone works before they activate it, so you'll need the headset. But after that, just wait a week or two and then take it in for replacement.

I did something similar with a phone a while ago and got a nice new phone out of it.

That reminds me though, you said you just got the phone right? If it was less than 90 days ago, take it back to the store and tell them to fix it. Under California law all products must have a minimum of a 90 day warranty.
