Yup - the fuck tards at Evil Bakery did the exact same thing to me. My case ended up going to a labor guy who took mys tatement over the phone - and I eneded up getting the back $$ I was owed, even tho I was already employed at Hope's. Hope your case turns out as well ! I think the way I 'got' Evil Bakery was because the wage they had been paying me, before I quit, was already far below the going rate for the work I was doing, and so unless they seriously upped my wage, ( which would never happen - the cheap fuckers ) I wasn't required to go back there - there's a chart somewhere on the NYS labor law site of labor rates. ALSO - when Bakery sent me a similar letter, Bakery did NOT state, as demanded by law, position hours, job title, or rate of pay. That makes their letter NOT A LEGITIMATE OFFER OF WORK - and so DOL in theory can not deny you back $$, since no real job offer was made. Dig ?
