I was talking to
roh_wyn the other day about my trip to the local court to hear oral arguments. She asked which judges had presided over the arguments and I told her, No, Posner wasn't there. I have never seen Judge Posner but from what I have heard of him, he seems to be quite the interesting personality.
Anyway. So last night I was reading a case for contracts before i decided to just stop reading midway and call it a night. It was fairly late and I figured I'll read first thing in the morning (which I did, by the way!). So what do I dream of? Oh the horror...
I'm in my contracts class. My prof this term makes us stand up to brief the case and throws questions at us while we brief. Sort of like an oral argument, actually now that I think about it. So anyway, I'm called on to brief the case that I half-finished last night. Who's the person asking me to brief it? Judge Posner. But for some reason he's a woman. Maybe because the judge who asked the questions at the real oral arguments was a woman. I don't know. But anyway, he calls on me and I'm freaking out because I have only read half the case and didn't fully understand it. When he asks for which Restatement applies to the case, I start asking my friends around me for their Restatements book so that I can somehow find the right rule.
I don't even know if I survived the briefing. I think I muddled my way through before the scene changed and I was spared any humiliation. Well, that was humiliating enough; I don't want to know how much worse I fared.
So this morning when I went back to that case to finish it up, I looked at the citation and the judge who wrote the opinion. You guessed it: Posner. And I don't think I even saw the name last night, before I went to bed.
I read all my assignments before I go to class but I'm definitely, definitely never giving myself the chance to go in unprepared. *shudder*
