It's too difficult to prove beyond a reasonable doubt that any given passenger was aware that the driver was under the influence, in breach of their license, or anything else. It's much easier to just say that the buck stops at the operator of the vehicle.
In this case, the police might charge the driver with vehicular manslaughter, but they're more likely to lay the same charges as they would if he was simply pulled over.
