You're talking about Locke's Law of Nature; "the natural condition of mankind, is a state of perfect and complete liberty to conduct one's life as one best sees fit, free from the interference of others." (http://www.iep.utm.edu/s/soc-cont.htm) But if you'd ever finished reading his Two Treaties on Government, you would know that he goes on and argues that absent a governing body to step in, once conflict errupts in the State of Nature, it is likely to continue because all people are, essentially, equal and there is no over-seeing authority to step in and take over. Hence his argument for a SOCIAL CONTRACT between the people and said over-seeing authority!
