I guess I hoped Kaye would be able to persuade some other members of the COurt of Appeals to grow a pair and do the right thing, but alas. The constitution of NY State doesn't REQUIRE gay marriage, but it doesn't PROHIBIT it either. Let's kick it to our ever vigilant state legislature and let them handle it ( Read more... )

It kind of seems like New York is becoming more and more conservative. And that's including the city.

It's more complex than that; basically this was a decision on all levels of passing the buck. Bloomberg, who I believe is genuinely pro-gay marriage, passed the buck in an election year by saying "let's see what the law is." The court passed the buck by saying "let's let the legislators figure it out." There's some messed up language I've read in pull quotes from the opinion, and I don't think that the guy who wrote the plurality (it was 3-1-2, dunno where the 7th vote was) is really on top of things ( ... )
