I came within a hair of doing the same thing to an senior last year... she was jaywalking as I was turning left at a t-intersection. I looked just in time to see her against my front fender and managed not to run her over, only brush her.
It's horribly unsetting, and I hope you mom's okay. In this case i suspect because there may have been an injury that the cops had to charge someone just to cover the bases... it's not their job to decide who's in the right. The judge will do that, and I'm sure your mom will be okay. A lawyer wouldn't hunt though.
Thankfully the Police called and told her to rip up the ticket as the cops followed up with witness accounts and came to the conclusion that she could not have seen him in time and that it is his fault he was hit.
