i think im going to need alot of strength to get through this. im starting to waver and feel guilt over this because his wife called my mom crying saying that not only is he going to miss his sons 1st birthday but also he has eaten or showered since he frist got arrested. She wanted to know if my brother was suicidel and now my mom has me second

While this is actually none of my business, I'd still like to butt in with my nosey opinion.

I think that you should stay behind your decision. If you let it go now, you'll never be able to do it, and your brother will know that fact. Think about the moment he hurt you, taking your rent money and pushing your mother down. Think about it and decide whether he deserves a punishment or not.
