I'm considering it, but the cops said that in cases where the defendant is young, you're unlikely to get any money out of them even if they're found guilty. There are too many ways they can get out of it. Like, even though the girls were obviously too drunk to walk, they were able to waive the breathalyzer and instead just demonstrate that they could walk in a straight line and answer simple questions. I can talk and walk in a straight line even when I'm completely plastered on three glasses of brandy and four glasses of wine.

x__x Yeah, the exact same thing happened in September, and I found firsthand that the insurance companies don't care about factors like alcohol or drug use. And when they put a value on damages, they use an "independent" appraisal agency called CCC which is known for fraudulent practices. But you can't do anything about it except sue... and the legal system is stacked in favor of the insurance companies.

... something's very wrong with the configuration of the road near your house, for that to keep happening. Seriously. They need to look into traffic calming changes, like bumps or roundabouts or clusters of reflective poles. Maybe someone needs to bring up the culpability of the local roads department. Clearly people keep thinking they can drive that road at a greater speed than they really can.

That just royally sucks!

It's not like I live on a corner or anything! I live in the middle of a perfectly straight stretch of street, a few houses down from a traffic light. And since it's a 30 MPH 4-lane road, they can't put in bumps or anything. A roundabout would probably help, because that intersection has poor visibility when making turns so there are a lot of accidents...

The real problem is that it's one of the major roads leading from the Towson bar district, and at 2AM there are a lot of drunks passing through. x__x

Maybe you should change to a better insurance company.
I've had good experiences with claims at Progressive. (I have no financial stake in that company, btw, just reporting experience as a consumer).

I've heard Progressive is pretty good, actually! I have Geico, and they've been very helpful both in this claim and the last... but in cases where the other driver is at fault, you get stuck dealing with their insurance company, which has even less vested interest in making sure you're satisfied. So with the insurance of the driver in doubt, Geico is going to have to sue them. Of course, that's not a real legal case, it's a back room deal worked out between two megacorporations. So the amount received is much less.

Sanada, that hasn't been my experience. Geico should give *you* the same value as your policy, it is up to them to try to offset that outlay to you by pursuing the other guy's insurance to reimburse themselves.

Hehe, she probably could... but I couldn't believe was that the officer didn't charge the driver with a DUI or anything. In MD, refusing the breathalyzer is considered an admission of guilt... but instead they had her just walk along one of the lines in the street. The officer even admitted that her ability to walk was obviously impaired, but she didn't fall down - and you have to make a serious stumble to be considered "drunk." Which sounds absolutely insane to me. From the skid marks, it's pretty clear that she veered into opposing traffic, and then cut back across two lanes to hit my car ( ... )
