renting an inlaw unit in sf is perfectly legal, which may be what is happening there (there are many converted sub-basement inlaw units that are legal thruout sf). however it is NOT legal to rent a unit where utilities are undivided UNLESS the landlord includes a set "utility amount" with the rent and handles it on their own. ie your rent is $2000, $400 of which is for utilities, and the same to the unit below, their rent + $400 for utilities. Unless you have had previous negative interactions with your landlord I would start from a place where you can expect fair and legal treatment. Everyone likes to be treated well, and if your landlord is a good person, then it doesn't make sense to immediately start in with accusations ( ... )

if you have a smart meter, you can go online and see the energy usage by the hour. if there are spikes of power usage while no one is home, something is mighty suspicious.
